CONDITIONS OF SALE

  1. CONDITIONS OF ITEMS SOLD. The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. No allowances will be made for any sale on account of any incorrectness, error in cataloging, or any imperfection not noted. No deductions will be allowed on damaged articles as all goods being sold are exposed for public exhibition and are sold "as is" and without recourse.
  2. BIDDING: The auctioneer reserves the right to reject any and all bids. The auctioneer has the right to bid on behalf of the buyers who have left bids and cannot be present.
  3. SOME ITEMS MAY BE SOLD SUBJECT TO RESERVE: Items having a reserve price established by the Auction Gallery and the consignor will be bid by the auctioneer or a member of his staff on the consignor’s behalf. The auctioneer may increase the bid himself to reach the reserve if necessary.
  4. MANNER OF PAYMENT: All buyers must pay cash unless credit has been established with the Gallery prior to the sale. The auctioneer reserves the right to hold the merchandise purchased by check until the check has cleared the bank if the Gallery deems such action necessary to protect its interest. Makers of bad checks will be prosecuted to the full extent of the law.
  5. TIME OF PAYMENT: All bills must be paid in full before leaving the premises on the day of the sale.
  6. REMOVAL: Removal shall be at the expense, liability and risk of the purchaser. The auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing the items at the expense and risk of the purchaser.
  7. ADDITIONAL TERMS AND CONDITIONS: Any additional terms and conditions of sale, added by the auctioneer, shall be announced prior to the sale.
  8. SALES TAX: All items are subject to the Rhode Island 7% Sales Tax unless we have a signed copy of your dealer’s exemption certificate.
  9. BUYER’S PREMIUM: A premium of 10% will be applied to the total purchase price of the items purchased. This premium will be paid by the buyer as part of the purchase price.
